A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

2. 피고인은 2012. 10. 4.경 위 같은 장소에서 위 피해자가 평소 밥을 적게 먹는 것에 대해 반성문을 작성하게 하였으나 피해자가 작성해 온 반성문 분량이 적다는 이유로 화가 나 피해자에게 “얼마나 선임이 한 말이 우습고 좆같으면 이 지랄로 써놨냐. 너 이 씨발, 이렇게 반성문 쓰고 가서 휴가 갔다 오면 너 털려고 선임들이 기다리고 있을 어쩌려고 이렇게 써놓고 가려 그랬냐. 미친놈아! 너 진짜 답답하다. 디질래. 씨발새끼야!”라는 등 말을 하면서 마치 피해자의 신체에 어떠한 위해를 가할 듯한 태도를 보여 피해자를 협박하였다.
