Defendant
A shall be punished by imprisonment with labor for one year and six months, and the execution of the above sentence shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Fraud;
A. From January 18, 2015 to January 19, 2015, from around 19:30 to January 05, 19, 2015, Defendant A engaged in gambling with the victim E, etc., Defendant A, using a title “a wood card” with which a special material can be identified in advance on the back of the card, and read a siren with which the above indication can be read, and leading the victims to take money. However, Defendant A scambling with “a wood card” offered for gambling was normal card, and as the Defendant participated in gambling, Defendant A was the victims, and scambling with the victims by using a title card 52 with the victims.
Defendant
A, as above, 80,00 won from the victim E who gambling, 3 million won from the victim C, 3 million won from the victim M, 8 million won from the victim N, and 7,60,000 won from the victim N, respectively, was acquired by deceptive means.
B. On January 22, 2015, around 19:30 on the 19:30, Defendant A: (a) deceiving the victims by the aforementioned methods in the Pelto 505 located in Gwangju Seo-gu, Gwangju; (b) obtained each of the aforementioned methods from the victim D; (c) KRW 1.8 million from the victim E; (d) KRW 700,000 from the victim E; (e) KRW 8 million from the victim N; and (e) KRW 5.3 million from the victim C.
2. On January 8, 2015, Defendant B, even though he was aware of the fact that Defendant B was gambling at a bus terminal in Seoul High-speed Seoul, Dong-gu, Seoul, and thus, sent the above “Ba- Card” and “special sirens” purchased in advance in order to assist the gambling, to A by means of the high-speed hand freight of Gwangju Pju.
As a result, Defendant B made it easy for Defendant B to gambling.
3. Habitual gambling (Defendant A, C, D, E, G, F, and H) Defendants also receive three copies of each card from around 20:00 on December 27, 2013 to the next 04:00 on the floor by using card 609 to each 52 card from around 20:00 on December 27, 2013.
