A defendant shall be punished by imprisonment with prison labor for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
"200 Highest 1181"
1. From around 05:00 on April 18, 2020 to around 06:36, the Defendant: (a) placed the victim D within the C coffee stores located in Jeju city B; and (b) stolen with the emull card owned by the victim.
2. The accused, in violation of the Fraudulent and Credit Finance Business Act;
A. On April 18, 2020, around 06:36, the purchase of goods equivalent to KRW 10,500,00, such as one diesel, two cigarette, etc. from F in Jeju E, which was offered to the employees of convenience stores by presenting and settling the stolen personal card to the employees of convenience stores as if it were one’s card;
(b) purchase of food equivalent to KRW 18,00, such as Kim(b), from I located in He on the same day of the second 06:49 on the same day, presented and settled as if he was his card, and received property from the injured party, as in paragraph 1 above;
C. At around 06:51 on the same day, at the place specified in paragraph 2(a) above, the Plaintiff purchased one cigarette worth KRW 45,000 at the market price, and the Plaintiff was issued property from the Victim G by presenting and settling the stolen e-mail card to employees of the convenience store as if the card was one’s own card.
Accordingly, the defendant, by deceiving victims, received property and used stolen cards.
On April 21, 2020, the Defendant: (a) around 14:15 on April 21, 2020, at the Jeju Central Branch of K Bank Jeju, the Defendant carried out the following: (b) one mobile phone of which the market price of the victim’s possession cannot be determined; (c) one mobile phone of which the victim’s ownership cannot be determined; and (d) 75,000,00,000,00,000,00, or the cash card, or the recipient card, etc. of the said mobile phone.
Accordingly, the defendant stolen the victim's property.

1. A theft Defendant: (a) around 21:30 on May 27, 2020, had a victim M within “F” located in Jeju city E, and (b) K physical card in the name of the victim.
