A defendant shall be punished by imprisonment for a period of five months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On December 26, 2019, the Defendant: (a) obtained one copy of the Victim D’s C Game site located in Dongjak-gu Seoul Metropolitan Government on December 26, 2019; (b) but did not take necessary procedures, such as returning it to the victim; and (c) had the Defendant thought to use it.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. On December 26, 2019, the Defendant violated the Fraud and the Specialized Credit Financial Business Act: (a) purchased a 1 turn-on 1,00,00 square meters from the F stores located in Yeongdeungpo-gu Seoul, Yeongdeungpo-gu and the third floor; (b) by deceiving the victim by suggesting that the victim is a legitimate holder, and was issued an 89,000 won-on 1,000 won-on 1,000 won-on 1,000 won-on 20.
Accordingly, the defendant, by deceiving the victim, received property and used the lost card.
3. Computer etc. fraud and violation of the Specialized Credit Financial Business Act;
A. On December 26, 2019, at around 21:37, the Defendant purchased one cans at the market price of 1,000 won from the vending machines located in the Young-gu, Yeongdeungpo-gu, Seoul Metropolitan Government subway Station 1, the Young-gu, Young-gu, the Si, Pepsicom, which is equivalent to the market price of 846 subway 1,00, from the vending machines located in the Young-gu, Young-gu, Young-gu, Seoul, the Defendant obtained financial benefits equivalent to the same amount by settling the card information of KRW 1,00, and using the lost card.
B. On December 26, 2019, at around 22:28, the Defendant purchased one cans from vending machines located in subway No. 4 lines of subway No. 750 located in Si/Gun, Gunpo-si, Gunpo-si, the market price of which is equivalent to 1,400 won, and made it possible for the Defendant to recognize the card information to enter into a vending machine settlement system without authority, and obtain and lose the same amount of financial benefits by settling KRW 1,400, the following charges.
