피고인은 2017. 2. 12. 14:00 경 서울 중랑구 면목 3.8동에 있는 ‘ 소파상상 어린이공원 ’에서 피해자 C( 여, 7세) 의 부 D이 피고인의 아들을 다치게 한 것에 대해 보상을 해 주지 않는다는 이유로 화가 나서, 몸으로 피해자를 밀쳐 바닥에 엉덩방아를 찧게 하는 폭행을 가하였다.
