1. Basic facts

A. On March 28, 2013, the Plaintiffs are operating a lodging business under the trade name, namely, “Gelel” when purchasing from the former owner F the ownership of one-half shares of each one-half share of the six-story accommodation facilities on the Gyeonggi-gun E, Gyeonggi-do (hereinafter “instant land”) and the six-story accommodation facilities on its ground.

B. Defendant C, who owns H 751 square meters adjacent to the instant land (hereinafter “the adjoining land”) and accommodation facilities and housing with the third floor above the ground, operates accommodation business in the name of “Iel (former Jel)” in the said building; Defendant D, who owns K 1,049 square meters (hereinafter “the adjoining land”) and accommodation facilities and housing with the third floor above the said building, operates accommodation business with the trade name of “Lel” in the said building.

다. 피고 C은 I 모텔을 운영하면서 ① 별지 도면 표시 18, ㄷ, ㄴ, ㄱ, 3, 4, 5, ㅊ, ㅍ, ㅎ, 13, 14, 15, 17, 18의 각 점을 순차로 연결한 선내 ‘나’부분 181㎡을 점유사용하고, ② 같은 도면 표시 ㅊ, 5, 6, ㅁ¹, ㄹ¹, ㄷ¹, ㄴ¹, ㄱ¹, ㅎ, ㅍ, ㅊ의 각 점을 순차로 연결한 선내 ‘다’부분 지상에 쇼파 등을 설치하여 위 ‘다’부분 23㎡를 점유사용하며, ③ 같은 도면 표시 15, ㅍ, ㅎ, 14, 15를 순차로 연결한 선내 ‘마’부분 지상에 쇠기둥, 천막 등을 설치하였으며, 같은 도면 표시 17, ㅁ, ㄹ을 순차로 연결한 선 및 같은 도면 표시 ㅌ, ㅋ을 순차로 연결한 선 위에 시멘트 벽돌 담장을, 같은 도면 표시 ①, ②를 연결한 선 위에 적벽돌 대문을 축조하여 위 ‘마’부분 43㎡를 점유사용하고 있다. 라.

Defendant D is occupying and using the portion of “A” in the line which connects each point of 1,2, 3, 1, 2, 3, 1, 3, 18, and 1 in sequence, with a fence attached on the line which connects each point of 18, 3, 2, 1, 13, 18, and 1 of the above drawings, while operating the Lel.
