Reasons
Punishment of the crime
On December 20, 2019, the Defendant was sentenced to a suspended sentence of two years in the Seoul Central District Court for night residence intrusion larceny, etc., and the judgment became final and conclusive on the 28th of the same month.
[Criminal facts]
1. On September 13, 2019, the Defendant embezzled nine (9) property of the victims’ possession at least eight (8) times in total, as shown in the attached Table 1 of the List of Crimes, including:00, around 08:00, the Defendant embezzled nine (9) property of the victims’ possession, without taking necessary measures, such as acquiring a gallon of the victim’s cattle lost by the victim C, and returning it to the victim.
2. On September 13, 2019, the Defendant in violation of the Act on Business of Fraud and Credit-based Financial Business purchased the instant World Cup, etc. at the convenience store operated by the Dispute Resolution Co., Ltd. on September 13, 2019, the Defendant settled KRW 58,240,00 in total over 16 times from around that time until September 12:16, 2019, by presenting that he/she had completed the instant MG Saemaul Card, as described in the foregoing 1.
Accordingly, the defendant deceivings victims to acquire 58,240 won property benefits, and used lost check cards.
3. On September 18, 2019, the Defendant attempted to commit fraud: (a) purchased goods at “F store” operated by the victim’s name in the Gwanak-gu Seoul Special Metropolitan City, Gwanak-gu, Seoul Special Metropolitan City, and presented to the employees the KEB card under the name of G acquired as if the credit card was its own credit card; (b) however, the Defendant failed to commit an attempted act on the wind for which approval of payment is refused by a credit card loss report.
4. On September 20, 2019, the Defendant, at night, operated the victim’s name in Gwanak-gu Seoul Special Metropolitan City H around 04:35.
