A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. On December 27, 2019, the Defendant: (a) obtained one copy of Samsung Card (C) that was destroyed by a victim B, who was located far from the bottom of the Incheon Gyeyang-gu Subdivision; and (b) embezzled the property that he/she had thought to have, without following necessary procedures, he/she did not return it to the victim; and (c) embezzled the property that he/she left the possession of the victim.
In addition, from around that time to February 17, 2020, the Defendant embezzled the credit card, which escaped from the possession of the victims over 10 times in total, as shown in the attached Table 1 of Crimes List 1.
2. On January 3, 2020, the Defendant violated the Fraud and Specialized Credit Financial Business Act: (a) around 14:03, at Eve stores located in Gyeyang-gu Incheon Gyeyang-gu, the Samsung Card acquired, as described in paragraph (1) above, was conducted as if it were one’s own possession; (b) presented it to the victim’s non-name employees; and (c) received goods of an amount equivalent to KRW 6,550 from the victim; and (d) used the lost credit card.
In addition, from December 29, 2019 to February 19, 2020, the Defendant deceiving victims by the same method 57 times in total, as shown in attached Table 2, and received property equivalent to KRW 1,358,360 in total, and used lost credit cards.
3. On January 6, 2020, the Defendant attempted to commit fraud: (a) purchased goods, etc. at G convenience stores located in Gyeyang-gu Incheon Gyeyang-gu Incheon, and (b) presented as if an employee, who was the victim, had legitimate right to use the Samsung Card, acquired as stated in paragraph (1) above, and had the victim settle the amount equivalent to KRW 4,500 and intended to receive the goods; (c) but did not commit an attempted act due to a report on the loss of the card.
In addition, from around that time to January 28, 2020, the Defendant attempted to induce victims to receive goods by the same method five times in total, as shown in the attached list 3.
