Reasons
Punishment of the crime
1. On May 16, 2014, the Defendant: (a) opened a mobile phone from a mobile phone sales store located in the Dong-gu, Dong-gu, Chungcheongnam-gu; (b) opened a mobile phone No. 30; (c) opened the mobile phone No. 454; and (d) opened the mobile phone No. 454, May 16, 2014; and (c) used the phone No. 4
Around May 26, 2014, the Defendant called D to read “D to make a cell phone case as a service,” and made D enter D as a mobile phone sales store, and made D to the effect that “10,000 won is paid from No. 10,000 won” was already known to the effect that D had already drafted an application for subscription to a cell phone with respect to an opened mobile phone, and made D, without authority, not knowing whether he/she applied for a new mobile phone entry, to prepare one copy of the application for subscription to a cell phone under the name of D, which is a private document concerning a certificate of fact, without authority, and forged a copy of the application for subscription to a cell phone under the name of D, which is a private document concerning a certificate of fact.
2. On May 26, 2014, the Defendant submitted an application for admission to a forged mobile phone at the above mobile phone sales store to an employee under the name in which the SK Telecom Co., Ltd. may not know of such fact.
3. Around May 26, 2014, the Defendant, by deceiving D and hiding the preparation of an application for joining a mobile phone, pretended as if he/she duly obtained permission from D, the nominal owner, and filed an application for opening a mobile phone with the victim SK Telecom Co., Ltd. using an application for joining a forged DNA, as prescribed in paragraph (1).
However, if the defendant opens a mobile phone in the name of D, he thought that he used it and did not pay it.
Accordingly, the defendant deceivings the victim SK Telecom Co., Ltd. as if the defendant was a mobile phone that normally opens the finish in the name of D, and its affiliation is equivalent to 79,700 won from the victim SK Telecom Co., Ltd.
