A Imprisonment for eight months, Defendant B, C, and D are punished by a fine of three million won, and Defendant E is punished by a fine of one million won.
Reasons
Punishment of the crime
1. Any person who has not registered with the Commissioner General of the Korean National Police Agency, which was a sole criminal offense by Defendant A, shall not conduct driving education for motor vehicles outside the driving school in return for payment;
Nevertheless, from August 8, 2015 to 19th of the same month, the Defendant provided driving education for automobiles more than three times in total, as shown in the attached Table Nos. 4, 32, and 33 in the table of crime, at least three times, on the 171st day in the south-gu Seoul Metropolitan City, and around the test site for driver's license, and received 2.60,000 won as tuition fees, and provided driving education for automobiles to L using a MEX car owned by the Defendant at a single road near the test site for driver's license.
Accordingly, the defendant provided driving education outside a driving school without registering the local chief of the Korean National Police Agency.
2. A person who has failed to register a driving school with the Commissioner General of the Korean National Police Agency for a public contest by Defendant A and Defendant B shall not conduct driving education outside the driving school in return for payment;
Nevertheless, on August 2015, Defendant A received 70,000,000 won as tuition fees from N in the vicinity of the examination site of a driver's license in Gangseo-gu Seoul, Gangseo-gu, Seoul and received 171,000 won for the vehicle driving education. Defendant A and Defendant B provided N with driving education using the OEM car owned by Defendant B at the Han-gu road near the examination site of the driver's license, along with the implementation of driving education for the vehicle driving education for the vehicle more than 17 times in total, as shown in the [Attachment] No. 9, 15, 16, 19, 20, 21, 27, 29, 35, 36, 38, 40, 41, 46, 48, 50,51.
Accordingly, the Defendants conspired with the Commissioner General of the Korean National Police Agency to conduct driving education outside a driving school without registering the driving school.
