1. Defendant A and joint criminal acts committed by Defendant D - Any person who intends to establish and operate a driving school for motor vehicles violating the Road Traffic Act due to the use of similar names of a driving school shall register with the local Commissioner General of the Korean National Police Agency according to necessary conditions, and anyone who fails to register a driving school shall not display or advertise his/her trade name using a name similar to a driving school

Nevertheless, without registering a driving school, Defendant A opened and operated an Internet advertising website under the name of “E” from around February 2014 to June 2017 without registering the driving school, and posted a letter to inform the elementary driver, etc. of the procedure for acquiring the driver’s license, counseling through the representative telephone (F), and joint Defendant D received an application for education on driving on the road under employment of Defendant A from around February 2016 to January 2017, and managed the website of “E”, and delivered the fee received from the instructors to Defendant A.

As a result, Defendant A and Co-Defendant D conspired to post or advertised a trade name using a name similar to the vehicle driving driving school without registering the vehicle driving school.

2. No person who fails to register a driving school that violates the Road Traffic Act due to education for driving without registration shall conduct driving education for motor vehicles outside the driving school in return for payment;

Nevertheless, without registering a driving school, the Defendant: (a) from September 2016 to February 2017, at the Jeonju week, and from around G, by reporting the “E” website as set forth in paragraph (a) of Article 1-A; and (b) by introducing 72 persons who applied for a road driving training, thereby allowing G to conduct a road driving training; and (c) G is granted a total of KRW 16,842,00 from the applicants for the above training to receive an aggregate of KRW 16,842,00 for the road driving training expenses.
