A defendant shall be punished by imprisonment for a term of one year and two months.

1.450,000 won shall be additionally collected from the defendant.

Punishment of the crime

On March 22, 2012, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Control of Narcotics, Etc. at the Jeonju District Court on March 22, 2012, and was sentenced to six months in imprisonment with prison labor for a violation of the Act on the Control of Narcotics, etc. at the Daegu District Court on June 21, 2013, and completed the execution of each sentence at the Chuncheon Prison on January 27, 2014.

Criminal facts

The defendant is not a person handling narcotics.

1. At around 21:00 on December 4, 2015, the Defendant: (a) opened approximately 2.1g of psychotropic drugs-related Mepters (one philopon; hereinafter “philopon”); and (b) transferred KRW 6.50,00 to the national bank account in the name of E in return for the payment thereof on the roads of the Melopum C Stopon, Nam-gu, Dong-gu, Seoul Special Metropolitan City; and (c) transferred KRW 50,000 to the national bank account in the name of E.

Accordingly, the defendant purchased the native medicine.

2. Acceptance of psychotropic drugs;

A. On July 21, 2015, around 21:00, the Defendant: (a) 707 of “G hotel” located in the Donnam-gu, Dongnnam-gu F, Seocheon-gu; (b) 0.7g of philopon contained in D in a disposable injection machine.

B. Around 04:00 on January 10, 2016, the Defendant, within a passenger car parked on a road near I hotel located in Chungcheongnam-nam Budget Group H, 0.35g of philopon, which was 0.35g from D in a disposable injection machine.

C. At around 04:00 on September 26, 2016, the Defendant received approximately 0.05g of clophones, which were contained in the one-time injection machine, from K, on the roads near J Station located in Jung-gu, Seoul.

Accordingly, the Defendant received psychotropic drugs three times.

3. Medication of psychotropic drugs;

A. On July 21, 2015, around 21:00, the Defendant injected approximately 0.05g of philopon into one’s arms, which was located in the “G hotel” F in the dong-gu, Chungcheongnam-gu, Chungcheongnam-gu, Yancheon-si, and then injected it into one’s arms.

B. On January 9, 2016, at around 23:30, the Defendant: (a) injected approximately 0.1g of philopon on the side of an expressway parked on the side of the expressway at the time of Jinju; and (b) injected it into his arms with a disposable injection machine.
