A Imprisonment with prison labor of one year and six months, and Defendant B shall be punished by imprisonment with prison labor of six months.

However, as to Defendant B, this shall not apply.

Punishment of the crime

On September 4, 2013, Defendant A was sentenced to a suspended sentence of ten months for the crime of violation of the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. in the Sungnam Branch of Suwon District Court on September 4, 2013, and on July 24, 2014, the Suwon District Court sentenced Defendant A to ten months of imprisonment for the crime of violation of the Act on the Control of Narcotics, etc. at the Suwon District Court on July 10, 2014, and the said sentence became final and conclusive on October 10, 2014, and completed the said suspended sentence.

Defendant A is not a person handling narcotics, “2016 Highest 1477”- Defendant A is not a person handling narcotics.

1. Purchasing psychotropic drugs;

A. At around 19:53 on March 28, 2016, Defendant A opened approximately 0.5g of psychotropic drugs from J on the roads near I Station located in H in Jung-gu Seoul Metropolitan Government (one philopon; hereinafter “philopon”), Defendant A 300,000 won for its payment.

B. At around 19:26 May 20, 2016, Defendant A opened approximately 0.4g of philopon from J around L Station located in Songpa-gu Seoul, Songpa-gu, Seoul, and 200,000 won to J as a price therefor.

Accordingly, the Defendant traded psychotropic drugs on two occasions.

2. Medication of psychotropic drugs;

A. On March 28, 2016, Defendant A injected approximately 0.05g of philopon from the toilet located near the Iscopon in Seoul Jung-gu, acopon, into his arms, around 0.05g of scopon, and injected it into his arms.

B. On May 21, 2016, at around 00:00, Defendant A injected approximately 0.3g of philopon from toilets of 402, Seongbuk-gu, Seongbuk-gu, Sungnam-si, Sungnam-si, with bio-dives, and injected it into his arms.

Accordingly, the Defendant administered psychotropic drugs twice.

3. At around 13:50 on May 21, 2016, Defendant A, who possesses psychotropic drugs, kept approximately 0.09g of philopon, contained in a single-use injection machine in the room No. 402 of Seongdong-gu, Sungnam-gu, Sungnam-si.
