A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2019 Highest 175] On November 14, 2018, the Defendant posted a false letter stating that “I will sell fluice powder in KRW 120,000,000 by accessing the Internet B Kaf-C at an insular place,” and that “I will send fluice powder to the victim D who reported the fact that I would first deposit 120,000,000 won.”
However, at the time, the defendant did not have any income or property and did not have any clear property, so even if he received the money from the victim, he did not have the intention or ability to send the money to the victim.
Nevertheless, the Defendant received KRW 120,000 from the victim to January 14, 2019, a total of KRW 7,974,000 from the victims over 58 times in total, as described in the attached list of crimes, since the Defendant received KRW 120,00 from the victim to the E bank account (F) in the name of the suspect on the same day.
Accordingly, the defendant was provided property by deceiving the victims.
[2019 Highest 323] On October 13:16, 2018, the Defendant stated that “The Defendant immediately transfers 4.50,00 won to a part-time student, if he/she sent 4.5 million won to a part-time student, he/she would transfer her to the house” to the victim H who became aware of in the B Kapet “G” at the beach of Busan Shipping Daegu Shipping Daegu, Busan.
However, at the time, the Defendant did not want to receive money directly from the Defendant’s account, rather than the part-time student, and did not have any clear income or property, so even if he received money from the victim, the Defendant did not have any intention or ability to pay the money.
Nevertheless, the Defendant received 450,000 won from the victim’s account (F) in the name of the Defendant on the same day.
Accordingly, the defendant was given property by deceiving the victim.
