The prosecutor's appeal is dismissed.
Reasons
1. Summary of the grounds for appeal;
A. Since a person who received personal information from the head of the redevelopment and consolidation project association, who is a personal information manager, should be deemed as a defendant, the defendant constitutes a violation of the Personal Information Protection Act as long as the defendant used the personal information for
B. In the case of the facts charged in this case, there is room to regard the personal information manager under the Personal Information Protection Act as D who received the personal information from the association pursuant to the law. As long as the defendant who received the personal information from D, which is the personal information manager, uses it for other than the purpose of provision
2. The summary of the facts charged is that Defendant A is the husband of B redevelopment project partnership C, and belongs to B’s emergency measure division.
No person who has received personal information from a personal information manager shall use such personal information for any purpose other than the intended purpose of receiving it or provide it to a third party.
Nevertheless, during May 2017, the Defendant secured 962 list of land owners based on the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents, which was based on the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents, in relation to the progress of the B Housing Redevelopment Improvement Project, and possessed on May 22, 2017, and used the personal information for purposes other than its original purpose by sending it for non-purpose purposes, by sending it to the Nam-gu Incheon Metropolitan City Council, Seo-gu, Incheon Metropolitan City, which is the domicile of the members of G, and to the Incheon Southern-gu, which is the domicile of the members of the association.
