1. The Defendant’s KRW 8,224,052 as well as the Plaintiff’s annual rate of KRW 5% from March 24, 2014 to July 26, 2017.

1. Occurrence of liability for damages;

A. The facts of recognition (1) around 17:20 on March 24, 2014, the Plaintiff suffered injury, such as the sniffe, the sniffe and the external side of the sniffe and the sniffe in order to convert the sn beam into the sniffe at the site of the construction of the b main complex building (hereinafter “instant construction”) while the sniffe tried to move the sniffe by cutting the sniffe with the sniffe at the speed of the sniffe, and

(2) The Samsung C&T Co., Ltd. contracted the instant construction from ELDC Co., Ltd., and subcontracted the instant construction to the Shipbuilding Co., Ltd. (hereinafter “Nonindicted Co., Ltd.”). On February 3, 2014, the Plaintiff is a worker who entered into a labor contract with the Nonparty Co., Ltd. upon receiving KRW 170,000 per day between the Nonparty Co., Ltd. and receiving KRW 30,000 per day.

Article 9 (Compensation for Loss) (1) The defendant is bound to compensate for the loss to be borne by the insured due to an occupational accident occurred to the insured worker according to the terms and conditions and the special terms and conditions.

Article 1 (Compensation for Damages) of the General Terms and Conditions of Liability for Accident Compensation (Compensation for Damages) that the Defendant bears refers to the damages arising from the following accident compensation liability:

For workers subject to the Labor Standards Act: Article 1 (Compensation) (1) of the General Terms and Conditions of Compensation for Damages, which are borne by the defendant under Articles 9 (Compensation) of the General Terms and Conditions of Compensation for Damages and the Acts and subordinate statutes related to the accident compensation liability and accident compensation (including other Acts and subordinate statutes related to the Industrial Accident Compensation Insurance, accident compensation) of the General Terms and Conditions of Compensation for Damages under Articles 78 through 80 of the Labor Standards Act and Articles 82 through 84 of the same Act,

(2) The above amount of damage shall be limited to cases where the payment is made under the special terms and conditions of accident compensation liability and the Industrial Accident Compensation Insurance Act.
