Defendant shall be punished by a fine of KRW 700,000.
If the defendant fails to pay the above fine, 50,000 won shall be one day.
Reasons
Punishment of the crime
The defendant, AO, and AP have conspiredd to acquire money by forging a real estate lease contract and providing it as security.
1. On March 26, 2010, the Defendant, AO, and AP had a seal with which the trade name located in the Jung-gu in Busan on or around March 26, 2010 is hard to be identified, and had a seal in the column for indicating the real estate in the real estate lease agreement, “(1 floor) from among the buildings on the 3rd floor of Geumsan-gu Agu, Geumsan-gu, Qu,” “30 million won” in the column for the deposit money for the lease of real estate; “Y, Jan. 10, 2010”; “AS” in the column for the lessor’s address; “AS” in the lessee’s address column; “AS” in the lessee’s address column; and “AU” in the resident registration number column; and “AV” and “AO” with the name and seal affixed to AT after entering the name “AS” in the column for the name and seal attached to AT.
As a result, the defendant and AO, and AP forged one copy of the real estate lease agreement in the name of AT, a private document on rights and obligations, for the purpose of exercising.
2. The Defendant, AO, and AP conspired with the Defendant of the event of the above investigation document, and at the AX office located in the Jung-gu Busan, Jung-gu, Busan, a law firm AW at a time and time, they exercised the forged real estate lease contract as if it was duly formed.
3. The Defendant and AO, and AP, once and after the same time and place as set forth in paragraph (2), have transferred the claim against the victim for the right to claim the return of the lease deposit under the above lease agreement, as the Defendant and AO, and AO had concealed the said victim as the lessee had the right to claim the return of the lease deposit amount of KRW 30 million.
The defendant and AO, and AP received 3220,000 won from the victim to the AZ account under the name of AO community credit cooperatives, and received two copies of the 1 million won check issued by the National Bank.
