A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
On June 11, 1999, the Defendant was sentenced to one year of imprisonment with prison labor and three years of suspended execution for larceny, etc., and on March 2, 2006, the Daegu District Court sentenced a fine of two million won for larceny, etc. on August 12, 2008, the Defendant was sentenced to one year of imprisonment with prison labor and three years of suspended execution for larceny, etc. on August 12, 2008, and on June 24, 2009, the Defendant was sentenced to one year and six months of imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) in the Young-gu District Court Branch of the Daegu District Court on February 23, 2012, and completed the execution of the sentence on April 6, 2013.
1. Violation of the Aggravated Punishment Act;
A. On September 20, 2013, at around 12:33, the Defendant entered the victim D’s house located in Busan City, through the gate and window where the victim’s family members opened the house by making use of the cresh of the house, and entered 1.3 million won in cash owned by the victim D, and 1.7 million won in cash owned by D, the husband of D, and 1.7 million won in cash owned by the victim E, the husband of the victim, into the victim’s son’s room, and entered 20 million won in cash owned by the victim’s son, and entered 18k gold bars in the market price, one (6) 18k gold bars, 18k gold bars, and 2 Gabs.
B. On October 16, 2013, around 14:40 on October 16, 2013, the Defendant: (a) opened the gate and windows opened by the victim’s house located in the G of the victim H using the cresh in the house; and (b) opened the cresh, the Defendant cited five gold booms in total amounting to KRW 10,000,000,000 in the market price kept in the inner crepit; (c) five gold booms; (d) five gold brokes; (e) one gold brokes; and (e) one gold flaps in gold 10,000 won
Accordingly, the defendant habitually stolen the victims' property.
2. A quasi-Robbery Defendant, at around 15:10 on June 2, 2014, enters the house of the victim J(62 years of age) located in Sinsan City through the gate in which the victim was opened to perform a farming work.
