A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
On June 15, 2010, the Defendant was sentenced to imprisonment with prison labor for larceny, etc. at the Busan District Court, and on March 21, 2013, the Changwon District Court was sentenced to imprisonment with prison labor for night-time intrusion and larceny, etc. on March 21, 2013, and on July 16, 2015, the Busan District Court sentenced ten months to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Busan District Court on January 18, 2016.
The Defendant committed larceny on two occasions in total, as follows, under the status that the Defendant had no ability to discern things or make decisions due to the fluence of female objects, which is obsing women’s clothes, due to the following acts:
1. On April 4, 2016, the Defendant committed the crime: (a) around 08:20 on April 4, 2016, at the victim E’s house located in the Dondong-gun, Gyeongnam-gun, the Defendant opened a living room window with which the victim did not correct the house between his house and enter the house; (b) one precious metal b.00,000,000 won in the market price of the victim located in the Yndong-gun, the market price of which is equivalent to one million won in the market price; (c) one precious metal b.1; (d) one f., one f., the market price of which is equivalent to one million won in the market price; and (d) one f., one 18 K m., the market price of which is equivalent to 30,000,000 won in the market price; and (d) 1.53,000,000 won in the market price of K.
2. On September 8, 2016, the Defendant committed the crime: (a) around 18:00 on September 8, 2016, the Defendant: (b) at the house of Changwon-si, Changwon-si; (c) at the house of the victim G located in the second floor, opened a living room window not corrected between the victim’s house and entering the house; (d) at night-time, one for the victim’s own market price, which is equivalent to KRW 30,000,000,000, the market price of which is equivalent to KRW 14K gold-ro, one for the 14K gold-ro, the market price of which is equivalent to KRW 100,000,000,000; and (e) one for the 1,000,000,000 if the market price is unknown; and (e) 4, clothes;
