Reasons
Punishment of the crime
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) is a person engaging in driving a motor bicycle of GTS125 124CC;
On September 1, 2016, at around 23:25, the Defendant driven the above motorcycle while under the influence of alcohol of 0.181%, and proceeded with the four-lane road in front of the 614 Chuncheon-do Ddong, as in Gyeyang-gu, Incheon, at the speed of 61 to 70km, depending on three-lanes in the operational room from the ebbbbbial side of efficacy.
On the front of the running direction of the accused, the Dozy taxi drivered by the victim C (year 67) stops in accordance with the stop signal. On September 1, 2016, the Defendant was driving a motor bicycle while under the influence of alcohol of 0.181% in blood alcohol level at around 23:25 on September 1, 2016 and proceeded with a section of approximately 20km from the subspons below the Incheon Dong-gu Incheon Dong-dong (hereinafter “STS125 U.S.”) to the 614-do Do-dong, Gyeyang-gu, Incheon, by driving a motor bicycle without obtaining a driver’s license.
