피고인은 2016. 8. 22. 04:30경 광주 C에 있는 D 정문 경비초소 앞에서 경비근무 중인 D 경비과 소속 의무경찰인 피해자 E(21세)에게 ‘경찰서에 2,000cc 이상 차량은 들어가지 못하게 해라, 자동차를 폭파시켜버리겠다’고 하여, E이 ‘아저씨 이러시면 안됩니다. 집에 들어 가십시오’라고 하자, E에게 ‘뭐 아저씨! 집에 가라고 내가 누구인지 아냐 F 회장이다’라고 소리치면서 군화를 신은 발로 E의 왼쪽 정강이를 2회, 오른쪽 정강이를 1회 걷어차고, 같은 근무조인 같은 과 소속 의무경찰인 피해자 G(26세)이 이를 보고 말리면서 핸드폰을 이용하여 채증하려고 하자 발로 G의 오른쪽 발목 부위를 1회 걷어찼다.
