Reasons
Punishment of the crime
At around 15:30 on January 16, 2013, the defendant was present at the court of Incheon District Court No. 322, which is located in the Nam-gu Incheon Metropolitan City, as a witness of the defendant's violation of the Road Traffic Act of 2012 High and 1002, and was notified by the presiding judge of the right to refuse to testify under the Criminal Procedure Act, and took an oath without exercising it.
The Defendant, from the defense counsel of the foregoing case, determined that “D couple would drive”, and the witness considered “I am fine. I will be able to drive. I will be able to drive. I will be able to drive. I will be able to do so.” The Defendant divided the number of persons by writing and followed the Defendant’s question, “I am a witness driving.”
From the prosecutor, the Defendant continuously responded to the question “I need to see that the witness drivess on the Poday,” and the question “I need to be followed by the witness’s driver’s seat”, respectively.
However, as the above C’s former spouse on August 8, 2012, around 00:42, the Defendant driven the above D’s vehicle in lieu of the above C at the time when driving the E’s driver’s vehicle under the influence of alcohol of about about 50 meters from a section of about 111 meters from the front of the Nam-dong Seopo-gu Incheon Metropolitan City, Seopo-dong to the front road of the Japanese class in front of the Japanese class 111.
Accordingly, the defendant made a false statement contrary to his memory and raised a perjury.
