Punishment of the crime

1. Defendant A and Defendant D are Chinese nationals staying in the Republic of Korea who entered the Republic of Korea of short-term visa (C-3-8) around March 28, 2016, following the entry into the Republic of Korea of short-term visa (C-3-8) around May 20, 2016 and changed their sojourn status to a visa for visiting (H-2-5) around May 20, 2016.

Defendant

D is a Chinese national foreigner who enters the Republic of Korea for a short-term visa (C-3-8) on June 3, 2017 and stays in the Republic of Korea.

(a) No person who violates the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City shall move or arrange to move a person who has not obtained permission to extend his/her sojourn area to another area within the territory of the Republic of Korea after entering Jeju Special Self-Governing Province

Nevertheless, the Defendants entered the Jeju Special Self-Governing Province without a visa, and recruited Chinese people who intend to be employed on the land of the Republic of Korea to move to the land of the Republic of Korea, and illegally move to the area outside of the Do and received compensation for expenses and good offices, Defendant D was in charge of the solicitation of Chinese people who wish to move to the land, and J prepared the identification card and airline tickets of Chinese people who want to be used in disguised status, and Defendant A conspired to play a role of accompanying and leading Chinese people to the land.

위와 같은 공모에 따라, 피고인 D은 2017. 6. 10. 경 SNS QQ 메신저에 사증 없이 대한민국 제주 특별자치도로 입국한 중국 국적 외국인의 도 외 이동 알선 광고 글을 게시하여 이를 희망하는 중국 국적 외국인 B, C에게 서 경비와 알선 대가 명목으로 각각 250만 원, 350만 원을 받고 그들을 육지로 이동시켜 주기로 약속하였다.
