Reasons
1. Facts of recognition;
A. On September 1, 1997, Sambu Corporation completed the registration of ownership preservation with respect to the building of this case on the three-story 1st floor of the exhibition facility of the 1st floor of the 3rd floor of the Handong-gu, Daejeon, Seodong-gu, Daejeon, Spanish structure D No. 1, Spain, 288m2, 392m2, 369.48m2 (hereinafter “the building of this case”). The Defendant Promotion Corporation completed the registration of ownership transfer on December 27, 2002 on the ground that the building of this case was donated by December 26, 2002.
B. On March 26, 2003, the use of the first and third floors of the previous building was changed to each convenience facility. On December 23, 2011, the use was changed to the new building listed in the separate sheet (hereinafter “instant new building”).
C. On June 13, 2003, the Plaintiff entered into a lease agreement on the instant building with E exhibition hall (hereinafter “instant lease agreement”). The main contents are as follows.
(For the purpose of this Agreement, Section 1 (Purpose of Lease) is a general restaurant and other public restaurant for the provision of convenience to visitors to exhibition halls.
Article 2 (Term of Lease) The term of lease agreement shall be two years from the initial date of the lease agreement, and the starting date of the lease agreement shall be three months after the date of this agreement or from the first date of the actual commencement date of operation, which shall be two years (24 months) after the commencement of the lease agreement.
Article 3 (Rents and Rental Deposits) (1) The rent for the period specified in Article 2 shall be set at two thousand two hundred and sixty thousand won in daily gold (Won 28,460,000 and two separate taxes), and Eul shall pay the rent to A in such a manner as designated by A.
In addition, management expenses should be paid in the amount of KRW 7,15,000,000 (Won 7,115,000), which is the rent for six months.
Article 4 (Business Facilities of Lease Objects) (1) A shall provide lease objects to B as business places.
