1. Basic facts

A. The plaintiff council of occupants' representatives is an autonomous organization composed of the sectional owners of 10 and 48 households in Jeju-si A apartment (hereinafter "the apartment of this case"). The remaining plaintiffs except the plaintiff council of occupants' representatives are the buyers who purchased the relevant apartment of this case from the defendant BJ. 2) The defendant BJ is the project owner who newly constructed and sold the apartment of this case and the contractor who executed the new construction of the apartment of this case.

3) The Defendant Guarantee Corporation guaranteed the obligation to repair defects that occurred after the pre-use inspection on the instant apartment that Defendant BJ sold in units and executed. (B) The Defendant Guarantee Corporation concluded with Defendant BY 1 BK 151,9,312 for the guarantee period of the No. 1 BK 151,9,312 from January 28, 2013 to January 27, 2014, 379,898,280 from January 28, 2013 to January 3, 2018, 203 BM 303,918, 624 from January 28, 2013 to January 27, 2015 (the instant warranty contract between Defendant BJ 203,918,624 to January 27, 2013, between BN27,938, and Defendant BY 18,2968 to 28,297.

2) The instant apartment was inspected on January 28, 2013, and around that time, each of the instant apartment units was delivered to the sectional owners of the instant apartment units, and thereafter, the Plaintiff’s council organized the Plaintiff’s council of occupants’ representatives, the guarantee creditor of the instant apartment units was changed to the Plaintiff’s council of occupants’ representatives. (C) Defendant BJ failed to construct the instant apartment units, which should be constructed in accordance with the design drawings, or constructed the instant apartment units in a way different from the design drawings.
