A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On December 5, 2012, the Defendant sentenced the Seoul Northern District Court to imprisonment with prison labor for the crime of interference with business, etc. on December 5, 2012, and completed the execution of the sentence on November 26, 2013 by the Chuncheon Prison.

1. On April 5, 2014, around 08:30 on April 5, 2014, the Defendant interfered with the victim’s convenience store business by force by avoiding disturbance for about 45 minutes, such as: (a) the convenience store for the victim’s D operation in Jung-gu Seoul Metropolitan Government; (b) the victim’s sound under the influence of alcohol and preventing customers from entering the said store; and (c) the victim’s convenience store business.

On April 4, 2014, at around 13:00, the Defendant heard the victim’s words “whether or not he paid other credit rating” from the victim at the bed o point operated by the victim H (the age of 67) located in the G market located in Jung-gu Seoul, Jung-gu, Seoul. On March 7, 2014, around 13:07, the Defendant: (a) called the Defendant’s house located in C, Seoul Jung-gu, Seoul, on the phone of the police officer; (b) made a false report on the Defendant’s request for a police officer’s dispatch by phone call at 112, in the absence of any special reason to request a police officer’s dispatch; and (c) obstructed the police officer’s legitimate execution of duties concerning the police officer’s dispatch of the 112 report by fraudulent means from March 23:13, 2014, by having K and one other, dispatched to the scene; and (d) interfered with the police officer’s lawful execution of duties concerning the dispatch of the 112 report by means of fraudulent means, such as the list of crimes in attached Form No. 112 report.
