피고인은 2013. 6. 12. 19:00경 영천시 B 소재 경북영천경찰서 C파출소에서, D에 대한 폭행 사건의 현행범인으로 체포되어 조사를 위하여 대기하던 중 위 파출소 소속 경찰관 8명 및 D 등이 있는 자리에서 위 파출소 소속 경장 피해자 E에게 “수갑 풀어라 임마, 야 이 좆만한 새끼야, 이 씹할 놈아, 나는 널 꼭 죽일 것이다, 세상이 무너져도 너만을 칼로 푹 찔러 죽인다, 경찰 개새끼들 다 죽인다, 좆같은 새끼들”이라고 큰 소리로 욕설을 하여 공연히 피해자를 모욕하였다.
