Punishment of the crime

[Criminal Records] The Defendant was sentenced to six months of imprisonment with prison labor for occupational embezzlement from the Vice Branch of the Incheon District Court on October 22, 2014, and the said judgment became final and conclusive on November 5 of the same year.

1. 피고인은 2014. 8. 27. 경 김포시 C 건물 105호에 있는 D이 운영하는 ‘E’ 휴대 폰 판매점에서 고객인 F가 실 수로 위 판매점에 놔두고 간 주민등록증을 이용하여 KT 휴대전화를 가입한 다음, 그 휴대폰 판매 수수료 및 휴대폰 2대를 가로챌 것을 마음먹고, 검정색 필기구를 사용하여 KT 올레 모바일 가입 신청서 2 장의 성명 란에 “F”, 주민등록번호 란에 “G”, 신청자 란에 “F ”라고 기재하고 F의 이름 옆에 임의로 F의 서명을 하는 방법으로 KT 올레 모바일 가입 신청서 2 장을 위조한 후, 위조된 KT 올레 모바일 가입 신청서 2 장을 상위 휴대폰 판매 대리점인 ( 주) 엠피나 비의 성명 불상의 직원에게 팩스로 송부하였다.

For the purpose of uttering, the Defendant forged a private document on the rights and obligations of others, and used a forged private document.

2. The Defendant: (a) committed as if the F applied for the opening of the two mobile phones in the victim (ju) at the same time and place as above; (b) submitted two copies of the forged F’s application for the KT 2 mobile phone; and (c) received two copies of the Samsung 6 mobile phone from the victim, who received two copies of the forged F’s application from the victim, at the same time and place; and (d) granted the victim a mobile phone entrance fee of KRW 969,356, which is equivalent to the market value of Samsung 1.8 million on the same day.

Accordingly, the defendant was given property by deceiving the victim.
