Punishment of the crime

No one shall engage in speculative activities as a business by using slot machines or speculative gaming machines, other than speculative business.

피고인은 2016. 3. 11.경부터 2016. 4. 8.경까지 사이에 거제시 B, 2층에 있는 상호가 없는 게임장에서, 게임물관리위원회로부터 등급 분류가 거부된 사행성 전자식 유기기구인 야마토 게임기 13대, 반지의 제왕 게임기 2대, 체리마스터 게임기 1대를 각 설치하여 위 게임장을 방문하는 불특정 다수의 손님에게 위 게임기에 현금을 투입하게 한 후, 회전 기회를 제공하고 손님들이 시작 버튼을 눌러 베팅을 하게 하여 화면상의 그림이나 숫자가 돌아가다가 멈췄을 때 그림이나 숫자의 가로, 세로, 대각선의 배열이 일정한 규칙에 따라 일치되면 점수를 획득하게 하여, 야마토 게임기와 반지의제왕 게임기의 경우 1점당 5,000원으로 환산해 환전수수료 10%를 제외한 나머지 4,500원을 손님들에게 주고, 체리마스터 게임기의 경우 게임 종료 시 남게 되는 점수를 500점당 현금 10,000원으로 환전해 주는 방법으로 사행행위를 업으로 하였다.
