A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2016. 4. 경부터 2016. 7. 5. 16:30 경까지 사이에 거제시 C, 2 층에 있는 피고인 운영의 ‘D ’에서, 게임 물관리 위원회로부터 등급 분류가 거부된 사행성 유기기구인 야마 토 게임기 6대, 스핀 플러스 게임기 3대, 체리 마스터 게임기 1대를 설치하여 위 만화방을 방문하는 손님들 로 하여금 위 게임기에 현금을 투입하게 한 후 베팅을 하게 하여 화면 상의 그림이나 숫자가 돌아가다가 멈췄을 때 그림이나 숫자의 가로, 세로, 대각선의 배열이 일정한 규칙에 따라 일치되면 점수를 획득하게 하여 야마 토 게임기의 경우 1점 당 5,000원으로 환산해 환전 수수료 10%를 제외한 4,500원으로 환전해 주고, 체리 마스터 게임기의 경우 500점 당 1만 원으로 환전해 주고, 스핀 플러스 게임기의 경우 10,000점 당 1만 원으로 환전해 주는 방법으로 사행행위를 업으로 하였다.
