피고인은 2013. 11. 21. 01:20경 부산 부산진구 양정동 370에 있는 백조아파트 건너편 노상에서 피해자 B(51세, 남)으로부터 훈계를 들었다는 이유로 시비하던 중 피해자의 멱살을 잡고 흔들며 “니 하나 죽이면 그만이다”하면서 피해자의 옷을 잡아 업어치기를 하고, 넘어진 피해자의 목을 손으로 조르는 등 폭행하여 피해자의 목 부위가 빨갛게 부어오르고 얼굴이 긁히는 등 피해자에게 치료일수 미상 상해를 가한 것이다.
