Defendant
A shall be punished by imprisonment with prison labor for three years, by imprisonment for two years and six months, and by imprisonment for one year and six months.
Reasons
Punishment of the crime
[2015 Gohap169] Defendants are not all narcotics handlers.
1. Joint criminal conduct by Defendant A and B;
A. On September 201, 2014, the Defendants purchased approximately 3g of 500,000 won of hybrid tobacco in FU-PB-22 (FUB-22) ingredients of psychotropic drugs designated as temporary narcotics from their names in the AU’s cargo storage station located in Daegu-gu AT via the Internet, and received delivery.
B. On September 19, 2014, around 19:00, the Defendants purchased approximately 6g of hybrid tobacco of the ingredients of EFFF-PB-22 (FUB-22) in one million won, which is a psychotropic drug designated as temporary narcotics from their names in the Internet, at the cargo storage station of the above AU’s home, and received delivery.
As a result, the Defendants conspired to sell psychotropic drugs in two times.
2. The sole criminal conduct of Defendant A;
A. On April 15, 2014, the Defendant issued and received approximately 0.02g of hybrid tobacco containing “CUCHIC, FUB-PB-22 (FUB-22),” which is a psychotropic drug designated as temporary narcotics, in the vehicles of AI located in the Gu-U.S. AH room parking lot at the Gu-U.S. Si, Gu-si, and received them without compensation from AI.
B. (1) On October 10, 2014, the Defendant: (a) around 18:00 on the first half of October 2014, 2014, FUB-22 (FUB-PB-222) Hub Tobacco, a psychotropic drug designated as temporary narcotics, etc. (hereinafter referred to as “BU-PB-22”), all of which constitute “Hub Tobacco” as such ingredients.
