1. Defendant A and B’s violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud) are the representative director of AV who is a multi-level company that receives the investment by pretending to the used cars export business. A and a person who actually operates AX and AY, a multi-level company that receives the investment by pretending to receive the investment in the oil business with AW, and the person who performs overall control over the business affairs of the above company. Defendant A and B play a role of attracting investment and paying dividends against many unspecified persons as the president of the Ulsan mountainous district in AX, and A and A play a role of attracting investment funds to many unspecified persons.
With respect to AV, Defendants and AZ received money from many and unspecified persons in the manner of soliciting them to make an investment that “to purchase domestic used cars and export them to a foreign country, such as Vietnam and pay the principal and dividends of 10% per month.” In relation to AX and AY Co., Ltd., the Defendants and AZ received money from many and unspecified persons to purchase and sell petroleum at a large price, and obtain high profit by purchasing and selling them at a large price. In relation to AX and AY Co., Ltd., the Defendants and AY acquired money by inducing them to make an investment with a large amount of 5-10% per month for the investment amount, and if the said company made an investment by introducing investors, 3-7% amount of money for the investment amount, and pay the full amount of principal at maturity.”
On January 4, 2012, the Defendants conspired with the Z and made a false statement that the victim BB would pay high-rate dividends to the company AX-U.S. company located in the Dong-gu BA 11th floor of Ulsan-gu, Ulsan-gu, U.S., and that the principal will be guaranteed at maturity.
However, the above AX Co., Ltd. is about four gas stations.
