1. The Defendants respectively,
A. The Plaintiff A’s KRW 16,150,00 and the annual rate of KRW 5% from February 29, 2012 to August 23, 2012.
Reasons
1. Facts of recognition;
A. Defendant D is a person who actually operated Defendant H (hereinafter “H”) as a multi-level business entity that receives an investment by pretending to the oil industry.
Defendant E, who is the president of the Ulsan District of Defendant H, was in charge of attracting investment and paying dividends to many and unspecified persons. Defendant F is a person who works to attract investment to many and unspecified persons as the head of the Busan District of Defendant H’s Busan Branch.
Defendant G is the representative director of Defendant H.
B. In relation to Defendant H, Defendant D, E, and F recommended the Plaintiffs to make an investment that “I would make profits from purchasing and selling petroleum at a large quantity at low price.” The amount of 5-10% per month for the investment amount to be invested in the above company, and KRW 3-7% of the investment amount to be paid if I introduced investors and made them make an investment, and to pay the total amount of the principal at maturity.”
C. The Plaintiffs received the said investment recommendation from Defendant D, E, and F, and made an investment. Plaintiff A invested KRW 10 million on July 26, 201, KRW 40 million on October 10, 201, KRW 30 million on November 1, 201, KRW 10 million on February 29, 201, and KRW 90 million on February 29, 201, KRW 2000 on July 29, 201, KRW 10 million on July 29, 201, and KRW 10 million on July 29, 201.

8. A total of KRW 40 million invested on 29.20 million.
In addition, on January 20, 2012, Plaintiff C invested KRW 10 million out of the investment amount of KRW 40 million as of October 10, 201 of Plaintiff A on January 20, 201.
However, as the sales have increased by selling oil at a price below 10% of the gas station in the course of leasing and operating four gas stations, Defendant H was a structure where the sales have increased. Since it is difficult for each month to pay high rates of dividends, recommendation allowances, etc. to the investors, the dividends promised to the existing investors by using the investment funds attracting from subordinated investors.
