The defendant is innocent. The summary of this judgment shall be notified publicly.
Reasons
In the facts charged, the Defendant was operating a fishery product supplier in Daegu Northern-gu, the Bank of Korea (hereinafter referred to as the “D”), which was a fishery product supplier in the instant case. From around 2013 due to the influence of the Japan and the appearance of large discount, the sales of the said company was reduced rapidly since 2013; the financial institution’s liabilities such as KRW 2.2 billion; the amount of the financial institution’s liabilities such as bonds; the amount of not paid for the supply of fishery products exceeds KRW 800 million; the Defendant was unable to repay the interest on loans related to the officetel’s business promoted by the Defendant; and the Defendant did not intend or have the ability to pay the amount normally even if he was supplied with fishery products, notwithstanding the absence of the intent or ability to pay the amount normally.
1. On February 1, 2013, at the office of the above company around February 1, 2013, by deceiving victim F who operates E, as if he would make a normal settlement of price, and by deceiving, he received fishery products equivalent to the market price of KRW 1,058,00 from the damaged party, as well as by being supplied with fishery products equivalent to the market price of KRW 307,520,100,000, total market price of KRW 158,520,100,000 from the time of supply of fishery products as shown in the attached list of crimes (1) to April 10, 2014;
2. On February 1, 2013, at the office of the above company: (a) deceiving the victim H who operates G as if he would settle the normal price; and (b) from such deception, he received the supply of fishery products equivalent to KRW 2,745,000 at the market price from the damaged party; and (c) from such Si to April 31, 2014, he received the supply of fishery products equivalent to KRW 442,04,50 in total amount of KRW 377,062,50 in the market price through supply of fishery products equivalent to KRW 193 as shown in the annexed crime list (2).
Judgment
1. The summary of the defendant's defense counsel's assertion is that the defendant is supplied with fishery products in continuous business relations with the victims, but the defendant is unable to repay the price of goods due to difficulties in business.
