A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On October 13, 2015, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Assault, etc. against a driver): (a) around 21:05 on October 21, 2015, the Defendant: (b) had a proxy driver E ( South, age 36) drive the Defendant’s vehicle in the vicinity of the bus stop at D gas stations located in Guro-gu Seoul Metropolitan Government; and (c) had the victim E (the victim, South, age 36) who was seated on the rear left of the Defendant’s vehicle without any reason, while under influence
