A defendant shall be punished by imprisonment for two years.

가. 2013. 11. 7.자 피해자 C에 대한 상해 피고인은 2013. 11. 7. 19:20경 청주시 상당구 서문동에 있는 중앙공원에서, 지체장애 3급인 피해자 C(45세)이 “이전에 빌려준 돈을 돌려 달라”고 요구하자 화가 나 술에 취한 상태로 피해자의 양쪽 다리를 발로 5-6회 걷어차고, 이에 피해자가 경찰에 신고를 하기 위해 휴대전화를 꺼내자 그 휴대전화를 빼앗아 피해자의 얼굴에 집어던져 피해자의 왼쪽 눈썹 부위에 맞게 하고, 계속하여 발로 피해자의 얼굴 부위를 수회 걷어찼다.

나. 2014. 2. 13.자 피해자 D에 대한 상해, 재물손괴 및 피해자 E에 대한 폭행 (1) 피고인은 2014. 2. 13. 21:40경 청주시 상당구 F에 있는 G 식당에서, 피고인의 일행인 H과동석하여 술을 마시던 중, 마침 그 곳에 손님으로 찾아온 피해자 D(여, 48세)가 피해자와 채무 관계에 있던 위 H에게 “3년이 넘었으면 돈을 갚아야 하지 않느냐, 나도 돈이 없어 죽겠다, 돈을 달라”는 요구를 하였다는 이유로, 피해자의 얼굴을 주먹으로 수회 때려 바닥에 넘어뜨리고 발로 얼굴 부위를 2회 걷어찼다.
