A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 상해 피고인은 2012. 5. 30. 06:00경 경남 고성군 C에 있는 피해자 D(여, 53세)의 농장에서, 그전 ‘2012 고성세계공룡엑스포’에서 'D 서예 서각 개인전시회'의 수익금 정산 문제로 피해자를 만나려고 하였으나 피해자가 자신을 피한다는 이유로 화가 나 현관에서 기다리고 있다가 귀가하는 피해자를 보자, 피해자의 머리채를 잡고 방으로 들어가 방바닥에 머리를 수차례 처박고, 발로 피해자의 배를 밟고 주먹으로 가슴 부위 등을 수회 때려 피해자에게 약 1주간의 치료가 필요한 복부타박상 등을 가하였다.

2. The Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (hereinafter referred to as "ameras"), taken photographs of the victim against his will using a camera outside the clothes of the victim during the time, place in the preceding paragraph, and between the victim and being used for violence as referred to in the preceding paragraph.

3. On June 10, 2012, the Defendant violated the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection, etc. (hereinafter “Information and Communications Network Utilization and Information Protection Act”) sent text messages to the victim’s cell phone using the Defendant’s cell phone at a non-permanent place around 20:25, on the ground that the victim did not meet himself/herself and avoided, as indicated in paragraph (1) of the same Article, using the Defendant’s cell phone to the victim’s cell phone, including sending text messages with the effect that “if it is disclosed to the public by making it open to the public, anywhere, where it is possible to do so, bababbabababababababa” and then, reached repeatedly the text causing fear

4. The Defendant causing property damage: (a) around June 20, 2012, at the victim’s farm located in Gosung-gun, Gosung-gun; (b) prevents the victim from entering the farm by arbitrarily replacing the locks installed in container stuffs owned by the victim and attaching the wooden plates.
