A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On August 2016, the Defendant violated the Passport Act: (a) was issued with a passport in the name of the Defendant and consented to the issuance of the passport in an unlawful manner upon the request of the Defendant; (b) around August 24, 2016, the Defendant sent B B with a photograph of the trade name in Busan, and sent B with a photograph of the passport.
After August 25, 2016, the Defendant received a photograph for a passport made by combining B’s face from the Defendant at the Busan Southern-gu Office, Busan-gu Office, and submitted an application form for issuance of a passport under the name of the Defendant and the above synthetic photograph to the public official in charge of issuance of the passport, and received a passport under the name of the Defendant with the above synthetic photograph attached on August 26, 2016.
Accordingly, the Defendant, in collusion with B, submitted a synthetic photograph of the face of the Defendant and B in an unlawful way, and received a passport in an unlawful way, as shown in Appendix I.
2. On August 25, 2016, the Defendant in false entry in the passport, in collusion with B, submitted to the public official in charge of issuance of the passport who is aware of such fact, such as Paragraph 1, at the window of the application for the passport of the public service center of the Busan Southern-gu Office, Busan-gu Office, a photograph with a synthetic face of the Defendant and B, and made a false report to the public official on August 26, 2016, and made him enter false facts in the passport three times as shown in the attached list I of crimes.
3. The Defendant in collusion with B on September 2016, in order to offer a false entry and passport event, the Defendant reads to B a passport (a passport number: C) in the name of the Defendant, which was falsely recorded as of September 12, 2016, and B, on September 20, 2016, at the departure inspection place of the Kimhae International Airport.
