A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On March 21, 2019, the Defendant, at the Seoul Central District Court, sentenced ten months of imprisonment with prison labor for a violation of the Act on the Control of Narcotics, Etc. and two years of suspended execution, which became final and conclusive on March 29, 2019.

1. On May 2018, the Defendant: (a) came to know of C (D) (E) (a seller of philophones) through an even air search, which means philophones from the Internet website “B” on the early 2018, and (b) decided to purchase philophones while continuing to contact C through D.

On May 5, 2018, the Defendant deposited KRW 400,000 in G account (H) in the name of F, which the said C knew that it would deposit the purchase price of phiphone, and purchased KRW 0.5g of the phiphonephone 0.5g of the said phiphone 0,000 by using the said phiphone 0.5g, which was concealed at the place known through D.

B. On June 10, 2018, around 22:51, the Defendant deposited KRW 2,700,000 in the post office account (J) in the name of the first person known by C to deposit the purchase price of phiphones, and purchased KRW 3g of the said phiphones in the manner of 2,70,000 by putting about 3g of the phiphones concealed in the place known by C through D.

C. On July 9, 2018, the Defendant deposited KRW 400,00 with G account (L) in the name of Gangnam-gu Seoul Special Metropolitan City, and C deposited KRW 400,000,000, and purchased KRW 0.5g of the said opon 0.5g by putting approximately 0.5g of the opon in the drain hole, which is a place known through D, at a place known by C through D.

On July 14, 2018, the Defendant deposited KRW 750,000 from “N” located in Gangnam-gu Seoul Metropolitan Government M, with the post office account (J) in the name of one known by C to deposit the purchase price of phiphones, and purchased KRW 750,000 by putting one g of the phiphones in the open air of the air conditioner known by C through D, which is a place known by D.

2. The Defendant, who administered philophones, around 23:00 on June 19, 2018.
