1. Defendant A shall be punished by imprisonment with prison labor for a year and four months;

2. Defendant B shall be punished by imprisonment for a year.

Punishment of the crime

1. Defendant A and Defendant B conspired to use money for the purpose of criminal agreement or treatment fees, etc. by taking advantage of money from victims who make it known that they were same-sexs or sexually indecent acts by indecent acts, and to use it in the process of reporting and statement at police stations, agreement with victims and their negotiations, etc., while drunkly drunk in Seoul Jongno-gu, and by inducing them to have sexual contact with the same-sexs, they met the Defendants’ body by inducing them to have sexual intercourse. A and B conspired to use it by taking advantage of money under the pretext of criminal agreement or treatment fees, etc. from victims who make it known that they were same-sexs or sexually indecent acts by indecent acts.

At around 03:13 on January 7, 2018, the Defendants conspired as above with the victim D, and Defendant A received the victim’s E call from the victim while waiting for customers near the above C commercial area, and notified the victim in front of the cab seat, talk with the victim, confirm the same-sex, and by telephone that Defendant B is carrying the same-sex baby in the C commercial area, and let the victim reach the victim’s sexual organ by inducing sexual contact with the victim. At around 03:57 on the same day, Defendant A filed a false report with the victim that the cab passenger was not under the influence of alcohol. Defendant B again accepted the agreement and criminal consultation with the victim, and Defendant B accepted it.
