1. The Defendant Housing and Urban Guarantee Corporation and the Defendant Co., Ltd. among the lawsuits around the instant case and the preliminary claims.

Reasons

1. Basic facts

A. Korea Housing Construction Co., Ltd. (hereinafter “Korea Housing Construction Co., Ltd.”) concluded a housing sale trust contract under the Housing Act (hereinafter “the instant trust contract”) with respect to the instant previous land and the instant apartment to be constructed on November 29, 2006 upon the issuance of a housing guarantee certificate from the Defendant Housing and Urban Guarantee Corporation (hereinafter “the instant apartment”) on July 26, 2006, on the following grounds: (a) the Korea Housing and Urban Guarantee Corporation completed the registration of ownership transfer on the previous land of this case to the Defendant Housing and Urban Guarantee Corporation; and (b) the ownership transfer cycle after the construction of the instant apartment was completed thereafter.

Article 1 (Trust Real Estate) Trust real estate means a building constructed or built on the same land (hereinafter referred to as the “land”) for which Han River Construction intends to operate a housing construction project after obtaining approval of a project plan pursuant to Article 16 of the Housing Act.

Article 2 (Purpose of Trust) The purpose of this Trust is to manage, sell and dispose of trust real estate (including the transfer of ownership on land or house; hereinafter the same shall apply) by the Defendant Housing and Urban Guarantee Corporation, which provided a guarantee for sale, in case where the Korea Housing and Urban Guarantee Corporation, constructs houses and appurtenant or welfare facilities (hereinafter referred to as the “house”) on land and executes the sales contract for the buyers, or where it is impossible for Han River Construction to perform the sales contract.

Article 3 (Public Notice of Trust and Trust) (1) The Korea Housing and Urban Guarantee Corporation shall entrust the land to the Defendant Housing and Urban Guarantee Corporation, and the Korea Housing and Urban Guarantee Corporation shall acquire it.

(2) The Korea Housing and Urban Guarantee Corporation shall conclude a trust contract with respect to land without delay.
