A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

The defendant and the victim C (the 47 years of age) are legally married couples who reported marriage as of April 1, 2015.

1. 폭력행위등처벌에관한법률위반(집단ㆍ흉기등상해) 피고인은 2015. 5. 13. 10:00경 강릉시 D, 2층에 있는 피해자의 집에서, 피해자가 폭행 경위에 관하여 경찰에 신고하였다는 이유로, 피해자에게 “신고했냐, 씹할 년아. 너랑 안 산다.”등의 욕설을 하며 주먹으로 피해자의 머리 부위를 수회 때리고, 발로 피해자의 옆구리 부위를 수회 밟고, 손으로 피해자의 머리 부위를 잡고 화장실 문 옆에 찧는 등 폭행한 다음, 그곳에 있던 위험한 물건인 가위의 손잡이 부분을 쥐고 가위날 부위로 피해자의 가슴 및 배 부위를 수회 찌르면서 “죽여버린다.”고 말하는 등 피해자에게 약 2주간의 치료가 필요한 손목 및 손 부분의 타박상 등을 가하였다.
