A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

1. The Defendant, along with a person whose name is unknown, committed a fraud using computers, etc.: (a) by deceiving the victim by misrepresenting the victim of the Financial Supervisory Service to “to prevent the singishing fraud” by misrepresenting the victim’s staff; and (b) by deceiving the victim with information necessary for remittance, such as the account number and password of the account in which the deposit is held by the victim; (c) remitting the deposit from the victim’s deposit account to another person’s bank account without authority using such information; (d) the Defendant, upon the direction of the person whose name is unknown, withdrawn the deposit transferred by using cash card, deposit passbook, etc.; (e) obtained 1% of the withdrawn money; and (e) conspired to acquire pecuniary benefits by again transmitting the remaining money to the person whose name is unknown.

On July 15, 2014, at least 10:00, a person whose name is unknown, misrepresented the victim C (year 72) by telephone and misrepresenting the staff of the Financial Supervisory Service to transfer money from the victim’s account. In order to prevent Bosing fraud, a person whose name is unknown means to identify the above information by having the victim enter the account number, password, telebanking number, resident registration number, etc. of the Agricultural Cooperative Account in the name of the victim into the cell phone pressing, and then, from around 11:5 to 12:33, the above information was discovered. From around 11:55 to around 12:3, 2014, 15,60,112 won from the victim’s known deposit account (D) to the victim’s SK securities account (F) account in the name of the victim, 306, 1506, 160, 2516, 160, 1560, 260, 2615, 36, 15, etc.
