A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2014dan508] Around February 5, 2014, the Defendant posted a letter stating that “beber6 mobile phones are sold” on the Internet website B, even though he/she did not intend or have the ability to sell his/her mobile phone, and reported it to the victim C, who visited the victim, “I sell beer6 mobile phones in KRW 170,000,” and then, he/she received KRW 170,000 from the victim C to the Defendant’s bank account, the Defendant’s wife, for the purpose of paying for the mobile phone amount, from that time to February 24, 2014, he/she received KRW 1,35,000 in total six times, as shown in attached Table 1, from that time, from February 24, 2014.

1. On February 20, 2014, the Defendant posted a false statement on the NA E bulletin board stating that “The sales of a product with a desire to sell a desire to commit a desire to commit a crime” even though he/she did not have the intent or ability to sell a desire to commit a crime, and reported the false statement to the victim F who contacted the victim F, who sold a desire to commit a crime at KRW 64,00,000, by receiving KRW 64,000 from the victim F as the price for a desire to commit a crime.

Around February 26, 2014, the Defendant posted a false statement on the Internet website B stating that “I sell options interview 2,000 won or more” even though he/she did not intend or have ability to sell his/her mobile phone, and reported the false statement to the victim G who called “I sell 103,000 won with options interview 2,00 won or more.” The Defendant received 103,000 won from the victim G for the payment of the mobile phone from the victim G and acquired it by deception.
[2014Kadan634] On January 14, 2014, the Defendant posted a letter stating that he/she would sell a mobile phone at NAV E bulletin board even though he/she did not intend or have ability to sell the mobile phone, and makes a false statement to the victim H who visited him/her, stating that he/she would sell a mobile phone at 138,00 won.
