The defendant shall be innocent.

1. On March 9, 2014, the Defendant: (a) stated in the instant facts charged that the victim E (n.e., 44 years of age) together with the D restaurant located in Daegu-gu, Daegu-gu; (b) stated that the victim E (n.e., 10,00 won was changed; and (c) stated that “n.e., money on the south-gu, other than N. M. M. (n., n.e., money on the south-gu, would not be deducted; and (d) the victim’s shoulder, head, and kn.e., the kn., the victim suffered damage to the victim’s kn.e., the kn., the victim’s knife and the kn.e., the kn., the victim’s kn.

2. Determination:

A. The Defendant asserts that no assault was inflicted on the victim from an investigative agency to this court, and denies the facts charged.

B. As evidence consistent with the facts charged in the instant case, there are ① the E investigative agency and this court’s statements, ② G hospital diagnosis fee and investigation report (party investigation into G hospital), ③ 112 reported cases.

However, as examined below, ① it is difficult to believe the statements in E’s investigative agency and this court, ② G hospital diagnosis fee and investigation report (G hospital counterpart investigation) and ③ 112 reported case processing alone are insufficient to recognize the instant facts charged, and there is no other evidence to acknowledge it otherwise.

① E의 수사기관 및 이 법정에서의 진술 ⅰ E는 수사기관에서 ‘만취한 피고인이 식당 내 홀에서 자신에게 욕설을 하면서 손바닥으로 자신의 양쪽 어깨와 머리 부위를 2, 3회 때렸고, 식당의 주방에서도 손으로 자신의 머리 부위와 팔, 다리 전신을 사정 없이 잡아 당기고 뺨을 수회 때려 주방 바닥에 넘어뜨렸다.’고 진술하였고, 이 법정에서도 '피고인이 식당 내 홀에서 자신에게 욕설을 하면서 어깨와 뺨을 막 두들려 팼고, 주방에서도 주먹으로 머리를 때리고, 어깨와 팔 다리를 두들려 팼고, 자신을 넘어뜨리고 끌고, 냉장고에 엉덩이가 부딪히면서 긁히고...
