Reasons
1. Basic facts
A. The Plaintiff is a legal entity that is established for the purposes of the development, transmission, transformation, distribution of electricity resources, and business related thereto, and is an electric source developer who is running a business for the construction of J Transmission Cables (hereinafter “instant business”).
The Defendants are residents living in the vicinity of 421 square meters in Cheong-do, Cheong-do, Gyeong-do, where K steel tower, which is part of the instant business, or are jointly and severally with these residents to oppose the said steel tower construction.
B. The instant project is a national book project implemented in Gyeongnam-gun, Cheongnam-gun N, Cheongbuk-do N, and O, as part of the implementation plan for electric source development projects under the Electric Power Source Development Promotion Act, and is a project that connects power transmission lines of approximately 16 km from P substations to Q transmission lines. The purpose of the instant project is to increase the stability of the electric power system by entering the new R’s follow-up power generation lines into the system and to prepare for an increase in the volume of electricity due to an increase in the volume of electricity demand.
C. For the instant construction project, the Plaintiff obtained approval of the implementation plan under the Electric Power Source Development Promotion Act [the Ministry of Commerce, Industry and Energy’s announcement Ss (No. 26, 2007), and subsequent announcement by the Ministry of Knowledge Economy (No. 11, 2008), U (No. 5, 2010), and V (No. 14, 201).]
The purpose of the Plaintiff’s consultation with the landowner is to construct, own, and own electric structures in Cheongdo-gun, Cheongdo-gun, Cheongdo-do-gun, which is a K steel tower site, with superficies established from August 31, 201 to the surviving existence of the electric structures. A part of the land within 41,534 square meters and X 2,386 square meters, which is the neighboring area of the said steel tower site, is to use as access roads, workplace, etc. of the instant construction, or to use as access roads, workplace, etc. of the instant construction, and the portion for which consultation has not been made, upon receiving a decision to cite on June 11, 2012 from the landowner by applying for provisional disposition of the status of temporary use, etc. of land against the landowner as the Daegu District Court 2012Kahap159, respectively.
