1. On January 15, 2020, the Defendant embezzled the property that left the possession of the victim by acquiring one credit card (C) under the victim’s name, reporting to police stations, etc., from around the 35 Incheon Central Bus Terminal near the Michuhol-gu, Michuhol-gu, Incheon, Incheon, 2020, and then embezzlement the property that left the possession of the victim without following the procedure for returning it to the victim, such as reporting it to police stations, etc.

2. Fraud by using computers, etc.;

A. On January 15, 2020, at around 22:04, the Defendant purchased one drinking water and a ice cream equivalent to KRW 2,000 from the e-mail unmanned store in Michuhol-gu Incheon, Incheon, and paid it to the direct settlement machine using the victim’s credit card acquired as referred to in paragraph (1), thereby entering information without authority in the information processing device, such as computer, etc., and acquiring the same amount of property benefits.

B. On January 15, 2020, the Defendant, around 22:21, in the Michuhol-gu Incheon, entered information without authority in an information processing device, such as a computer, etc., and obtained pecuniary benefits equivalent to the same amount by paying KRW 1,650, by directly burning the credit card of the victim, as provided in paragraph (1), to use the subway, and paying KRW 1,650 to the subway card terminal.

C. On January 15, 2020, the Defendant, around 23:39, entered information without authority in an information processing device, such as a computer, and obtained pecuniary benefits equivalent to the same amount by paying KRW 1,250 of the same amount by directly rejecting the credit card of the victim, as provided in paragraph (1), to use the subway in the Han River 23-ro, Yongsan-gu, Seoul Metropolitan Government 44, Yongsan subway Station, and in the subway card terminal in order to use the subway.

3. The Defendant, at around January 15, 2020, presented the credit card acquired at the Michuhol-gu Incheon F and G convenience store, such as paragraph (1), to the employees of both convenience stores.
