A defendant shall be punished by imprisonment for four months.
Reasons
Punishment of the crime
1. On December 30, 2012, from around January 15, 2013 to around January 15, 2013, the Defendant embezzled the property that had been occupied by the victims on 13 occasions, as shown in Appendix I, without following necessary procedures, such as acquiring a copy of the driver’s license lost by the victim C in the Buddhist subway station of Gangnam-gu Seoul Metropolitan Government (hereinafter referred to as the “Seoul-gu”) and returning it to the victims.
2. On January 27, 2017, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit Business presented G credit cards acquired in the name of “F” store operated by the victim E in Seongdong-gu Seoul, Seongdong-gu, as shown in Section 7 of the attached Table I of Crimes Crimes List I, to the above store employees, and used the credit card lost by deceiving the victim or his employees and receiving goods for six times in total, as shown in Section 1, 2, 7, 8, 9, and 12 of the attached Table II from that time to August 30, 2017.
3. On August 7, 2017, around 08:44, the Defendant violated the Act on Specialized Credit Financial Business and the Act on Specialized Credit Financial Business: (a) opened H credit cards acquired as stated in paragraph 10 of the attached Table I of the Crimes List I by means of entering information into subway fare terminals managed by Seoul Transport Corporation; (b) opened the opening by means of entering information in contact with the victim’s subway fare terminals managed by Seoul Transport Corporation; and (c) without authority in the information processing device, as described in paragraph 3 of the attached Table II of the Crimes List II, acquired financial benefits equivalent to KRW 1,250, and used lost credit cards.
4. A defendant in violation of the Act on Financial Business Specializing in thief and credit-based financial business shall be attached to a self-reader who manages a person who causes damage to his/her name, and is installed at the village of Yongsan-gu Seoul, Yongsan-gu, Yongsan-gu, Seoul, by around August 7, 2017.
