1. The instant lawsuit was concluded on September 8, 2016 as deemed the withdrawal of the lawsuit.

2. The Plaintiff’s litigation costs after the completion of the lawsuit.

The fact that the Plaintiff was notified of the legitimate date for pleading, but was not present at the third day for pleading opened on May 26, 2016, the third day for pleading opened on May 26, 2016, and the fifth day for pleading opened on September 10, 2016, and the fact that the Defendants did not appear or did not appear and make a statement on each of the above dates for pleading is apparent in the record.

According to the above facts, the plaintiff and the defendants were absent on the date of pleading even after being notified of lawful date, and thus the lawsuit of this case was terminated on September 8, 2016 as deemed withdrawal of the lawsuit in accordance with Article 268(3) and (2) of the Civil Procedure Act.

Since the plaintiff's litigation relationship is unclear, such as submitting an application for designation, etc., a declaration of termination of litigation shall be made in order to clarify that the lawsuit in this case is terminated.
